As announced on the UPC website, the timeline for the UPC implementation has been pushed back and will now be implemented on 1 June 2023 (rather than April 2023). The sunrise period was also originally scheduled to begin on 1 January 2023. According to the UPC website, no further delays are expected however, Germany would need to deposit its instrument of ratification of the UPC Agreement in February to ensure this June start date.

The EPO announced that - although the Unitary Patent Court postponed the start for the UPC and the sunrise period by two months - applicants can still file early requests for unitary effect and for a delay in issuing the decision to grant a European patent already as from 1 January 2023. Thus, you may act even before start of the sunrise period to ensure to obtain a unitary patent for your pending EP application.
