Developments in the Dutch Patent Landscape

The Dutch government recently announced plans to make major changes to the Dutch Patent Act (Rijksoctrooiwet). The goal is to strengthen investment certainty and improve the competitiveness of Dutch businesses. [1]

 

Currently, patents in the Netherlands can be granted without a complete examination. This means that patent applications may not be checked for novelty or inventiveness before a patent is granted. The government believes this situation can create legal uncertainty and impact the reliability of patent protection for businesses and investors.

 

Under the proposed reform, all patent applications would receive a thorough examination by Octrooicentrum Nederland before any patent is granted. This aims to ensure that only inventions that meet the necessary criteria get protection, which would improve the quality and credibility of Dutch patents.

 

The reform also includes plans to simplify some existing patent rules to reduce administrative burdens for entrepreneurs.

 

If implemented, these changes could increase confidence in the Dutch patent system and contribute to a stronger innovation climate in the Netherlands.
